This presentation provides a primer on the history and status of abortion laws in Arizona and Utah with a focus on the impact of the decision on healthcare professionals and their legal counsel. This presentation begins with a history of the legal standards under Roe and Casey, addresses the proposed legislative initiatives in Utah and Arizona under “trigger laws” and ends with a discussion of the impact of such laws on healthcare providers including medical scenario hypotheticals, graduate medical education, HIPAA and mandatory reporting intersects.
Allison Davis is an associate in the Phoenix office of Snell & Wilmer, L.L.P. She is licensed to practice in Arizona and Utah and specializes in healthcare regulatory and transactional law. In her practice she advises a variety of healthcare clients on matters including compliance with state and federal facility and provider licensing, scope of practice concerns, Stark and Anti-Kickback law compliance and HIPAA. She also represents clients in all aspects of M&A transactions including managing transactions and drafting related documents, structuring healthcare transactions for compliance with federal and state laws including corporate practice of medicine restrictions, licensing requirements and Stark and Anti-Kickback prohibitions, and reviewing and advising clients on the impacts of certain transactions on existing licenses and accreditations.
