The City Attorney is looking for an attorney to practice in the Civil Division of the Office. The attorneys in the Civil Division are assigned to various practice areas as Office needs may change or arise over time.

Those practice areas could range from administrative law to zoning; and examples include construction of public works; constitutional law; contracts and intergovernmental agreements; economic development; elections; eminent domain; employment law (Title VII, Arizona Civil Rights Act, FLSA, ADA, ADEA, FMLA, etc.); environmental law; municipal finance and taxation; open meetings and public records; procurement; public utilities and telecom; real estate; water law; land use/zoning and more. While the currently anticipated practice areas for this position include real estate and land use, given the range of practice areas within the Civil Division the City Attorney will consider applicants whose prior experience may not include experience in the currently anticipated practice areas of need.

ABOUT THIS JOB

Position Specific Summary

The Principal Assistant City Attorney position in the Civil Division of the Tucson City Attorney’s Office provides advanced-level legal services andperforms advanced-level legal work in assigned areas of practice.  Attorneys at this level work with a high level of autonomy and accountability. Provides guidance and mentoring to lower-level attorney personnel.

Work is performed in accordance with general policies and established standards of the legal profession and is reviewed by the City Attorney or their designee. This position does not supervise.

Duties and Responsibilities

  • Responds to legal inquiries from the City’s executive management team and their staff, typically for assigned City departments. Identifies, analyzes and explains legal issues associated with projects and programs of City-wide importance. Performs advanced-level professional and administrative legal work including development of and revisions to the Tucson Code. Consults with client decision makers regarding departmental and major legal issues. Provides legal advice and assistance.

  • Prepares and reviews materials submitted to the Mayor and Council for its consideration and approval for legal issues. Prepares ordinances or resolutions for consideration by the Mayor and Council. Analyzes legal issues associated with initiatives under consideration by the City Manager or Mayor and Council. Consults with Mayor and Council and City management at public meetings and in executive sessions as needed. Guides and mentors lower-level attorneys.

  • Reviews and prepares a variety of legal documents including but not limited to contracts, intergovernmental agreements, legal correspondence, notices and position statements.

  • Litigates complex legal matters (in administrative matters; or in federal or state courts) in assigned area of practice, and/or supports litigation efforts in those matters by performing research, preparing and filing pleadings, making court appearances, etc.

  • Serves as litigator for the City in State and Federal Courts. Identifies, analyzes, and discusses legal issues associated with projects. Handles legal matters of assigned departments and acts as liaison with departments, the City Manager, and the Mayor and Council.

  • Performs other duties and tasks as assigned.  Any one position may not include all the duties listed. This position description identifies the responsibilities and tasks typically associated with the performance of the position.

MINIMUM QUALIFICATIONS

EDUCATION:
Juris Doctorate from an accredited law school

EXPERIENCE:
Five (5) years civil practice

LICENSES/CERTIFICATIONS:
Member in good standing of the State Bar of Arizona

PREFERRED QUALIFICATIONS:
Government law practice: including a working knowledge of the legal subject matter involved with the department to which assignment will be made.
Experience in the practice of municipal law including the review, negotiation, and drafting of contracts or other primary responsibility for participation in transactional work.
Experience advising executives on employment, discrimination, and labor matters.
Experience drafting position statements for submittal to outside state and federal agencies.
Litigation experience.

POSITION SUMMARY:
The Administrative Services Division of the Arizona Supreme Court is seeking an experienced attorney with a thorough understanding of administrative law, Arizona court rules and procedures, and federal law applicable to state government operations.

The Assistant Counsel is part of a Legal Services team dedicated to supporting the Chief Justice’s strategic agenda and the administrative management of the Arizona court system by providing the highest quality in-house counsel services to the Administrative Director of the courts and the staff of assigned divisions of the Administrative Office of the Courts.

This position will recommend, draft, and review administrative orders, court rules, administrative code provisions, policies and procedures to assure legality and clarity; advise Executive Management, court staff, and judicial department boards and committees regarding legal issues related to their duties; maintain legally correct standard form contracts; provide training and assistance concerning preparation of contracts and reviews; and approve contracts, grant agreements, and intergovernmental agreements.

This position will also identify the need for legislation; coordinate with the Office of the Attorney General where legal representation is needed for litigation; represent the Supreme Court in relation to the state departments and agencies and other entities doing business with the courts; and respond as requested by Arizona judges and court staff to legal issues regarding the application of law, court rules and administrative code provisions to court operations.

This position may be eligible for a hybrid-telework schedule once the employee has completed three (3) months of employment and has sufficiently proved their ability to perform assigned tasks.

Public Service Loan Forgiveness (PSLF) Program qualified employer.

MINIMUM REQUIREMENTS:

This position requires:

  • A juris doctorate from an ABA accredited law school, membership in the State Bar of Arizona or eligible for licensure through the Government Law Admission Program, and at least three years of experience as a member of the bar employed or retained by a large public or private organization. Other relevant experience may be considered to fulfill the three-year requirement.
  • Thorough understanding of the application of the Arizona Constitution, Arizona Revised Statutes, the Arizona Code of Judicial Administration, Arizona Rules of Court, Supreme Court administrative orders, Arizona common law, and federal law applicable to the state government operations.
  • Excellent legal research and writing, oral and written advocacy, project management, group process, statutory, court rule, policy and contract drafting, basic computer, planning, and organizational skills.
  • Comprehensive knowledge of fundamental legal principles and their application, particularly legal principles affecting the operation of government, specifically the court system.
  • The ability to distinguish legal issues and advice from policy issues and advice; to analyze difficult and complex legal problems and to apply legal principles and precedents to particular sets of facts; to clearly identify and explain inconsistency with law and its significance and propose corrective options; to organize ideas and present statements of fact, law and argument clearly and logically in written and oral form; and to analyze and draft highly complex contracts, reports, legislation, rules, legal memoranda and policy proposals.

The preferred candidate will have at least ten years’ experience as a member of the bar, employed in court administration, or performing in-house counsel duties.

Travel level: up to 5%.

Salary Range and Growth Potential: It is anticipated that an entry-level prosector will start at a salary around $103,000. The salary range for this Assistant City Prosecutor I position is $80,196 - $118,687 annually, with the potential to advance by noncompetitive promotion to Assistant City Prosecutor II ($88,397 - $130,824 annually) and to Assistant City Prosecutor III ($102,353 - $151,478 annually) upon meeting specific criteria-based promotion requirements.

An Assistant City Prosecutor I performs entry-level, professional legal work in the preparation and prosecution of cases in municipal court. An attorney in this class is given an extensive orientation in criminal prosecution activities and the various components of the criminal justice system. Responsibilities include: negotiating cases and plea agreements; conducting bench and jury trials; presenting motions, pleadings, and arguments in court; and interviewing witnesses, Police Officers, victims, and others. This class is also responsible for performing some appellate work and related duties as required.

This classification has been designated as a non-classified, non-merit system, at-will position. This class is distinguished from the next higher-level classification, Assistant City Prosecutor II, by the latter's increased responsibilities and greater degree of legal and administrative knowledge and expertise. Employees in this class may progress by noncompetitive promotion to Assistant City Prosecutor II upon meeting the specific criteria-based promotion requirements. This class is supervised by a Deputy City Prosecutor who reviews work closely during initial training; however, incumbents may receive functional supervision from an Assistant City Prosecutor II or an Assistant City Prosecutor III on a special project basis. However, incumbents are eventually expected to handle trial work independently and under more general supervision. This class is FLSA exempt-professional. (Part-time employees in this class are FLSA nonexempt).

This Civil Deputy County Attorney works within the Civil Services Division of the Maricopa County Attorney’s Office in the Appeals, Elections, Public Records, and Tax Group. The Civil Division of the Maricopa County Attorney’s Office represents and defends Maricopa County, its elected County officials, and employees in a variety of litigation matters in State and Federal Courts. The attorney selected for this position will be a part of the litigation team defending and handling cases that include excessive force, wrongful death, deliberate indifference, and other police liability matters; state law tort claims ranging from trip and fall to road design and maintenance issues; prosecuting environmental and zoning enforcement matters; defending medical claims, and other matters as necessary. The successful candidate will be the lead attorney on these cases as well as collaborating with others in the Civil Division to bring about successful resolutions to the cases, as well as providing clients with advice on litigation strategies and assessments of liabilities.

Job Contributions

    • Conduct legal research and analyze legal issues using both computerized legal research and hard copy tools

Acts as legal advisor to various departments, the City Manager, and the Mayor and Council. Identifies, analyzes, and discusses legal issues associated with city operations. Represents the City of Tucson's interests in legal proceedings, to include administrative hearings as well as litigation in state and federal courts

 

DUTIES AND RESPONSIBILITIES:*

General Description of Position

 

The City Attorney is looking for an attorney to practice in the Civil Division of the Office. The attorneys in the Civil Division are assigned to various practice areas as Office needs may change or arise over time.  Those practice areas could range from administrative law to zoning; and examples include construction of public works; constitutional law; contracts and intergovernmental agreements; economic development; elections; eminent domain; employment law (Title VII, Arizona Civil Rights Act, FLSA, ADA, ADEA, FMLA, etc.); environmental law; municipal finance and taxation; open meetings and public records; procurement; public utilities and telecom; real estate; water law; land use/zoning and more. While the currently anticipated practice areas for this position include real estate and land use, given the range of practice areas within the Civil Division the City Attorney will consider applicants whose prior experience may not include experience in the currently anticipated practice areas of need. The City Attorney may choose to hire more than one candidate from this recruitment.

 

Position Specific Summary

 

The Principal Assistant City Attorney position in the Civil Division of the Tucson City Attorney’s Office provides advanced-level legal services and performs advanced-level legal work in assigned areas of practiceAttorneys at this level work with a high level of autonomy and accountability. Provides guidance and mentoring to lower-level attorney personnel.

 

Work is performed in accordance with general policies and established standards of the legal profession and is reviewed by the City Attorney or their designee. This position does not supervise.

 

Duties and Responsibilities

  • Responds to legal inquiries from the City’s executive management team and their staff, typically for assigned City departments. Identifies, analyzes and explains legal issues associated with projects and programs of City-wide importance. Performs advanced-level professional and administrative legal work including development of and revisions to the Tucson Code. Consults with client decision makers regarding departmental and major legal issues. Provides legal advice and assistance.

 

  • Prepares and reviews materials submitted to the Mayor and Council for its consideration and approval for legal issues. Prepares ordinances or resolutions for consideration by the Mayor and Council. Analyzes legal issues associated with initiatives under consideration by the City Manager or Mayor and Council. Consults with Mayor and Council and City management at public meetings and in executive sessions as needed. Guides and mentors lower-level attorneys.

 

  • Reviews and prepares a variety of legal documents including but not limited to contracts, intergovernmental agreements, legal correspondence, notices and position statements.

 

  • Litigates complex legal matters (in administrative matters; or in federal or state courts) in assigned area of practice, and/or supports litigation efforts in those matters by performing research, preparing and filing pleadings, making court appearances, etc.

 

  • Serves as litigator for the City in State and Federal Courts. Identifies, analyzes, and discusses legal issues associated with projects. Handles legal matters of assigned departments and acts as liaison with departments, the City Manager, and the Mayor and Council.

 

  • Performs other duties and tasks as assigned.  Any one position may not include all the duties listed. This position description identifies the responsibilities and tasks typically associated with the performance of the position.

QUALIFICATIONS:

MINIMUM REQUIRED QUALIFICATIONS:
Education:
Juris Doctorate from an accredited law school
Work Experience:

Government law practice: including a working knowledge of the legal subject matter involved with the department to which assignment will be made.
Experience in the practice of municipal law including the review, negotiation, and drafting of contracts or other primary responsibility for participation in transactional work.
